• Any consequences arising from the use of custom instructions, including but not limited to customer interactions, business outcomes, legal compliance, and brand reputation.

3. Risks and Limitations

You acknowledge and understand that:

• AI systems can produce unpredictable, inaccurate, inappropriate, or harmful outputs, even with well-intentioned instructions.
• Custom instructions may cause the AI to behave in unexpected ways, including providing incorrect information, making inappropriate recommendations, or failing to respond appropriately to customer inquiries.
• The AI may misinterpret or incorrectly apply your custom instructions.
• Custom instructions may conflict with our base safety guidelines, potentially leading to unsafe or non-compliant outputs.
• We do not guarantee that custom instructions will work as intended or produce desired results.

4. Prohibited Uses

You agree NOT to use custom instructions to:

• Circumvent safety measures, content policies, or usage restrictions.
• Generate illegal, harmful, deceptive, discriminatory, or offensive content.
• Impersonate individuals, misrepresent facts, or engage in fraudulent activities.
• Violate intellectual property rights, privacy rights, or other legal rights.

THE CUSTOM INSTRUCTIONS FEATURE IS PROVIDED "AS IS" WITHOUT ANY WARRANTIES, EXPRESS OR IMPLIED. WE DO NOT WARRANT THAT THE FEATURE WILL MEET YOUR REQUIREMENTS, OPERATE ERROR-FREE, OR PRODUCE ACCURATE, SAFE, OR APPROPRIATE RESULTS. WE DISCLAIM ALL WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT TO THE MAXIMUM EXTENT PERMITTED BY LAW.

6. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, MISTARA LABS SHALL NOT BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES ARISING FROM OR RELATED TO YOUR USE OF CUSTOM INSTRUCTIONS, INCLUDING BUT NOT LIMITED TO:

• Customer complaints, disputes, or loss of customers.
• Reputational harm or brand damage.
• Legal claims, regulatory actions, or compliance violations.
• Any AI-generated content or behavior resulting from your custom instructions.

This limitation applies even if we have been advised of the possibility of such damages.

7. Indemnification

You agree to defend, indemnify, and hold harmless Mistara Labs, its affiliates, officers, directors, employees, and agents from and against any and all claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising from or related to:

• Your use of the Custom Instructions Feature.
• The content of your custom instructions.
• AI outputs generated based on your custom instructions.
• Your violation of this disclaimer, our Terms of Service, or applicable laws.

8. Monitoring and Enforcement

We reserve the right, but have no obligation, to monitor, review, or modify custom instructions. We may disable, remove, or restrict access to the Feature or your custom instructions at any time, with or without notice, if we determine (in our sole discretion) that they violate our policies, pose risks, or are otherwise inappropriate.
